By accessing our website or purchasing or using our Services, you agree to the Terms applicable to your use and purchase. Additional terms may apply to specific products, promotions, memberships, or services. Where additional terms apply, they will be presented to you before you make the relevant purchase.
Nothing in these Terms excludes or limits any mandatory rights you may have under applicable consumer protection laws.
If you do not agree to these Terms, please discontinue your use of the Services.
2. ELIGIBILITY AND ACCOUNT RESPONSIBILITY
You must have the legal capacity to enter into a binding contract to purchase our Services. If you are under the age of majority applicable to you, you may use or purchase our Services only where permitted by applicable law and with any required parental or guardian involvement.
When creating an account or purchasing a product, you agree to provide accurate, complete, and current information.
You are responsible for maintaining the confidentiality of your login credentials and for activities carried out through your account. Please notify us promptly at hello@clublifedesign.com if you suspect unauthorised access to your account.
You may not share your login credentials or transfer your account to another person unless we expressly permit this in writing or applicable law requires otherwise.
We may take reasonable steps to protect accounts, prevent fraud, and enforce these Terms, including temporarily restricting access where necessary. Any restriction or termination will be handled in accordance with applicable law and will not affect any rights you have that cannot lawfully be excluded.
3. OUR COURSES AND EDUCATIONAL SERVICES
Club Life Design provides educational content, courses, templates, resources, and training relating to user-generated content (UGC), content creation, social media, and related business skills.
The exact content and features included in a purchase will be described on the relevant sales page at the time of purchase. Depending on the product, this may include recorded lessons, downloadable materials, assignments, templates, community access, live sessions, or other resources.
Unless expressly stated in the relevant product description, purchasing a course does not include:
-
Done-for-you agency services or content production.
-
Guaranteed brand collaborations, client acquisition, or employment.
-
Guaranteed revenue, profit, or a specific financial outcome.
-
Personal coaching, individual feedback, or ongoing support beyond what is expressly included in the product description.
Our courses are designed to teach skills and provide educational guidance. Your results will depend on factors such as your effort, implementation, experience, communication, market conditions, and other circumstances outside our control.
We do not guarantee that you will secure a particular number of clients, collaborations, or paid opportunities, or earn a particular amount of money, unless an express written guarantee states otherwise.
We aim to describe our products accurately and deliver the features and content promised at the time of purchase. Nothing in this section limits your statutory rights if a product is not supplied as agreed or does not conform to applicable legal requirements.
4. PURCHASES, PRICING, AND PAYMENT
4.1 Prices
The price payable for a product will be displayed on the relevant sales or checkout page before you complete your purchase.
Unless otherwise stated, prices are displayed in euros (EUR). Any applicable taxes will be presented or charged as required by applicable law.
Promotional prices, discounts, bonuses, and special offers may be available for limited periods or subject to stated eligibility requirements.
We reserve the right to change prices for future purchases. A price change will not alter the agreed price of a completed purchase, except where a correction or adjustment is permitted by applicable law.
4.2 Accepted payment methods
Available payment methods will be displayed at checkout. These may include credit or debit cards and other payment services made available by our payment providers.
You authorise us and our payment processors to charge the payment method you select for the amount displayed at checkout.
You agree to provide accurate billing and payment information and to update it where necessary.
4.3 Instalments and recurring payments
Where a product is offered through an instalment plan or subscription, the payment amounts, payment frequency, duration, renewal terms, and applicable cancellation arrangements will be disclosed before purchase.
You are responsible for payments that are properly due under the payment plan you selected, subject to any applicable cancellation, withdrawal, refund, or other statutory rights.
A payment plan does not automatically create a right to cancel future payments simply because you stop using the course. Equally, nothing in this section prevents you from exercising a cancellation or withdrawal right available under applicable law.
4.4 Failed payments and suspected fraud
If a payment fails or is reversed, we may contact you to resolve the issue. Where legally permitted, we may temporarily suspend access to the relevant paid Services while a material payment issue remains unresolved.
We may decline or cancel an order where there are reasonable grounds to suspect fraud, unauthorised payment, or a material error in the order, subject to applicable law and any refund obligations.
5. DIGITAL DELIVERY AND ACCESS
Course access will be provided using the delivery method described on the relevant sales page or at checkout.
Access begins at the time communicated during the purchase process or when access is otherwise made available in accordance with the agreed product terms.
The access period, if limited, will be disclosed in the relevant product description. If no specific end date is stated, access will be provided according to the terms presented at purchase and applicable law.
You are responsible for having a compatible device, internet connection, and any software reasonably required to access the Services, unless the product description states otherwise.
We will make reasonable efforts to keep the Services available and functioning. Temporary interruptions may occur because of maintenance, technical issues, third-party platform outages, or other circumstances.
Where an interruption materially affects a paid Service, we will take reasonable steps to address the issue and provide any remedy required by applicable law.
We may make reasonable updates or changes to course materials to correct errors, improve clarity, maintain relevance, or improve the learning experience, provided that such changes do not unlawfully reduce the essential features or value of a product already purchased.
We will not use this provision to remove a material feature that formed part of an existing purchase without addressing any applicable contractual or statutory obligations.
6. VOLUNTARY 30-DAY MONEY-BACK GUARANTEE
6.1 Scope of the guarantee
In addition to any statutory rights that may apply, Club Life Design offers a voluntary 30-day money-back guarantee for eligible course purchases, subject to the conditions set out in this section.
This guarantee is intended for students who actively complete the course material and implement the methods taught but still believe they have not acquired the knowledge or skills necessary to implement those methods.
6.2 Eligibility requirements
To qualify for a refund under this voluntary guarantee, you must:
-
Complete the purchased course within the applicable 30-day period.
-
Complete all assignments and recommended homework included in the course.
-
Actively apply the strategies and methods taught in the course during that period.
-
Explain the steps you have taken to implement the course material and why, despite those efforts, you believe you have not acquired the knowledge or skills necessary to implement the methods taught.
You may be asked to provide reasonable information or supporting evidence relevant to these requirements so that we can assess your request.
A change of mind, a decision not to continue with the course, a lack of time to complete it, or expectations that differ from the product description do not, by themselves, establish eligibility under this voluntary guarantee.
6.3 How to request a refund under the guarantee
To request a refund under this voluntary guarantee, email hello@clublifedesign.com within 30 calendar days of your purchase.
Use the subject line REFUND and include:
-
Your name and purchase email address.
-
Your order details or order number.
-
Confirmation that you completed the course and assignments.
-
An explanation of how you applied the material and why you believe you have not acquired the skills or knowledge described above.
The request must be received within the applicable 30-day period. The period is calculated from the purchase date, subject to any mandatory rules governing the calculation of time limits.
We will review the request against the eligibility requirements and communicate our decision within a reasonable period.
If your request qualifies under the guarantee, we will arrange a full refund of the amount covered by the guarantee, using the original payment method where reasonably possible, subject to applicable law and payment-provider procedures.
6.4 Relationship with statutory consumer rights
This voluntary guarantee is separate from any statutory right of withdrawal and any statutory rights relating to the conformity, supply, or performance of digital content or digital services.
The eligibility conditions in this section apply only to the voluntary guarantee. They do not impose additional conditions on statutory rights where applicable law does not permit such conditions.
Nothing in this section excludes, restricts, or replaces any mandatory consumer rights or remedies available under applicable law.
7. STATUTORY WITHDRAWAL RIGHTS
Depending on your location, the nature of your purchase, and the applicable law, you may have a statutory right to withdraw from a contract within a specified period.
For eligible consumer purchases governed by EU law, a 14-day withdrawal period generally applies to distance contracts, subject to applicable exceptions and requirements.
Digital content supplied without a physical medium may be subject to specific rules. In certain circumstances, a consumer's statutory withdrawal right may be lost when the supply begins, but only where the legally required conditions have been satisfied.
Where required, we will seek the necessary express consent and acknowledgement before beginning the relevant digital-content supply, and we will provide the required contract confirmation.
Purchasing a course, accessing a lesson, or accepting these Terms does not, by itself, establish that all legal requirements for losing a statutory withdrawal right have been satisfied.
If you wish to exercise an applicable statutory withdrawal right, contact hello@clublifedesign.com and clearly state that you wish to withdraw from your purchase. You may also use any legally prescribed withdrawal procedure applicable to your contract.
Nothing in these Terms limits any longer withdrawal period, refund entitlement, or other statutory remedy that may apply where the legal requirements have not been met.
8. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise stated, the website and its content, including course videos, written materials, lesson structures, graphics, photographs, templates, downloads, frameworks, branding, logos, software, and other educational resources, are owned by or licensed to Opulent Satin, Lda.
These materials are protected by applicable intellectual property laws.
Subject to your compliance with these Terms and payment of the applicable purchase price, we grant you a limited, non-exclusive, non-transferable licence to access and use the purchased course materials for your own personal learning.
Unless we give prior written permission or applicable law permits it, you may not:
-
Copy, reproduce, redistribute, or publicly share course materials.
-
Resell, sublicense, or commercially distribute our templates or educational resources as standalone products.
-
Share login credentials or provide unauthorised access to paid course content.
-
Record, reproduce, or distribute course lessons or live sessions without permission.
-
Use our course materials to create or distribute a competing educational product.
-
Remove copyright notices or other proprietary notices from our materials.
Nothing in this section prevents you from applying the skills and knowledge you learn to legitimate business activities, including creating UGC, working with clients, seeking paid collaborations, or developing your own business.
Your licence to use our course materials does not transfer ownership of those materials to you.
9. STUDENT WORK, CONTRIBUTIONS, AND FEEDBACK
You retain ownership of original work that you create independently, subject to third-party rights and any separate agreements you enter into.
If you submit content, assignments, photographs, videos, testimonials, or other materials to a community or service, you remain responsible for ensuring that you have the necessary rights and permissions to share them.
You must not submit content that infringes another person's intellectual property, privacy, publicity, or other legal rights, or that otherwise violates applicable law.
Where you provide feedback, suggestions, or ideas about our website, courses, or Services, you grant us permission to use that feedback to improve our business and Services without compensation, provided that doing so complies with applicable law and does not improperly disclose your personal information.
We do not acquire ownership of your original student work merely because you submit it to us.
We will obtain any separate permission required before using identifiable student work, names, images, testimonials, or other personal content in marketing or promotional materials.
10. COMMUNITY CONDUCT AND PROHIBITED ACTIVITIES
You agree to use our website, courses, and community spaces lawfully and respectfully.
You must not:
-
Use the Services for unlawful, fraudulent, or deceptive purposes.
-
Access or attempt to access another person's account without authorisation.
-
Share, sell, or redistribute paid course materials without permission.
-
Circumvent technical restrictions or security measures protecting the Services.
-
Use automated tools to scrape, extract, or systematically collect content or personal data without authorisation.
-
Upload malware or other material intended to disrupt or compromise our systems.
-
Harass, threaten, impersonate, defame, or unlawfully discriminate against other users or our team.
-
Post spam, fraudulent offers, unauthorised advertising, or misleading claims.
-
Infringe intellectual property, privacy, or other legal rights.
-
Interfere with the operation or security of the website, course platform, or community.
-
Use the Services in a manner that violates applicable law or these Terms.
Nothing in this section prevents you from applying the skills learned through our courses to your own business or from engaging in lawful commercial activities that do not infringe our rights.
11. USER CONTENT AND COMMUNITY MODERATION
Where our Services include community spaces or allow you to submit content, you are responsible for the content you post or share.
We do not claim ownership of your original content merely because it is posted within a community or submitted through our Services.
We may remove or restrict content, or take action against an account, where we reasonably believe this is necessary to address unlawful content, harassment, fraud, intellectual property infringement, security risks, or a material breach of these Terms.
Where appropriate and legally required, we will provide an explanation of the action taken and an opportunity to address the issue.
We will handle personal data associated with user content in accordance with our Privacy Policy and applicable law.
12. THIRD-PARTY PLATFORMS AND SERVICES
Our Services may be delivered through or link to third-party platforms, payment providers, software, websites, or services.
Your use of a third-party service may be subject to that provider's own terms and privacy policy.
We are not responsible for the independent operation of third-party services beyond the responsibilities imposed on us by applicable law or any commitments we expressly make.
Where a third-party issue materially affects a Service we have agreed to provide, we will take reasonable steps to address the issue within our control and provide any remedy required by law.
13. CHANGES, SUSPENSION, AND TERMINATION
We may update or modify our website, correct errors, improve features, and maintain our Services from time to time.
Where changes affect an existing paid product, we will act in accordance with the contract and applicable law.
We may suspend or terminate access where there are reasonable grounds, including a material breach of these Terms, suspected fraud, unauthorised sharing of paid content, or a serious security risk.
Where appropriate, we will provide notice and an opportunity to remedy the issue before restricting access, unless immediate action is reasonably necessary or notice is not appropriate or legally required.
Any suspension or termination will be proportionate to the circumstances. It will not remove any statutory rights or remedies you may have, including any applicable rights relating to paid access that has not been provided as agreed.
You may stop using the Services at any time. Stopping use does not automatically cancel a payment obligation or create a refund entitlement, except where provided by the applicable purchase terms or law.
14. WEBSITE AVAILABILITY AND MAINTENANCE
We aim to keep our website and Services available and functioning properly, but uninterrupted access cannot be guaranteed.
Temporary interruptions may occur due to maintenance, technical issues, internet connectivity, third-party outages, or circumstances beyond our reasonable control.
We will take reasonable steps to restore affected Services and communicate material issues where appropriate.
Nothing in this section excludes responsibility for a failure to supply or maintain a paid Service where we are legally responsible for that failure.
15. DISCLAIMERS AND EDUCATIONAL RESULTS
Our educational materials are provided to support learning and skill development.
Unless expressly stated in a product description, our courses do not guarantee a particular financial result, level of income, number of collaborations, client acquisition, employment outcome, or business performance.
Examples, case studies, testimonials, and student results illustrate individual experiences and should not be understood as a guarantee that you will achieve the same outcome.
Your results depend on many factors, including your skills, effort, implementation, experience, market conditions, and circumstances outside our control.
We aim to ensure that product descriptions and educational materials are accurate and appropriate for their stated purpose. However, we cannot guarantee that every item of general educational information will remain suitable for every individual or circumstance.
Nothing in these Terms excludes or limits liability or statutory remedies that cannot lawfully be excluded or limited.
16. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
Subject to that restriction, we are responsible for losses that are reasonably foreseeable consequences of our breach of contract or failure to exercise the care required by applicable law.
We are not responsible for losses caused solely by circumstances outside our reasonable control, or for losses arising from a user's misuse of the Services, to the extent that such exclusion is permitted by law.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Where applicable law permits a limitation of liability, any limitation will be interpreted only to the extent legally enforceable and will not deprive consumers of mandatory statutory rights or remedies.
17. INDEMNIFICATION
If you use the Services in a way that unlawfully infringes another person's rights or causes damage through your wilful misconduct or unlawful actions, you may be responsible for the resulting loss to the extent provided by applicable law.
Nothing in this section requires a consumer to indemnify us for losses caused by our own breach of contract, negligence, unlawful conduct, or other circumstances for which we are legally responsible.
18. PERSONAL DATA AND PRIVACY
We process personal data in accordance with our Privacy Policy and applicable data protection laws.
Our Privacy Policy explains the categories of personal data we collect, the purposes and legal bases for processing, how information is shared, how long it is retained, and the rights available to individuals.
You should review the Privacy Policy to understand how your personal data is handled.
Nothing in these Terms constitutes consent to personal-data processing where separate consent is legally required.
19. ELECTRONIC COMMUNICATIONS
We may communicate with you electronically in connection with your purchase, account, course access, support requests, and other contractual matters.
Where permitted by applicable law, electronic communications and records may satisfy legal requirements for written communications.
You are responsible for providing a valid email address and keeping it up to date so that you can receive important information about your purchase and account.
Any consent required for marketing communications will be handled separately where applicable. You may unsubscribe from marketing communications using the available unsubscribe mechanism, without affecting essential communications relating to your purchase or account.
20. COMPLAINTS AND DISPUTE RESOLUTION
If you have a complaint or concern about a purchase or Service, please contact us first at hello@clublifedesign.com and provide sufficient information for us to identify the issue.
We will review complaints in good faith and aim to respond within a reasonable period.
Where appropriate, we may seek to resolve a dispute through informal discussions. This does not prevent either party from exercising any legal right, meeting a statutory deadline, or starting proceedings where permitted by applicable law.
Nothing in these Terms requires you to participate in arbitration or another dispute-resolution process where doing so would be unlawful or would restrict a mandatory consumer right.
21. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Portugal, except to the extent that mandatory laws applicable to a consumer in their country of residence provide otherwise.
Where you are a consumer, the choice of Portuguese law does not deprive you of protection afforded by provisions of law that cannot lawfully be excluded by agreement.
Any dispute will be handled by the courts or other competent bodies determined under applicable law. Nothing in these Terms deprives a consumer of a right to bring proceedings before a court that has jurisdiction under mandatory consumer-protection rules.
22. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business operations, or legal requirements.
The effective date at the beginning of this document indicates when the relevant version takes effect.
The version applicable to a purchase will be determined in accordance with the contract and applicable law. We will not apply changes retroactively to remove rights already acquired or to materially alter an existing contract where doing so is not legally permitted.
Where required, we will provide notice of material changes and obtain any necessary agreement.
We encourage you to review the current version when using our website or purchasing additional Services.
23. GENERAL PROVISIONS
These Terms, together with the applicable product description and any additional terms provided at purchase, form the agreement governing your use of the relevant Services, subject to any mandatory rights under applicable law.
If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Our failure to enforce a provision immediately does not necessarily mean that we waive our right to enforce it later.
Nothing in these Terms creates a partnership, employment relationship, or agency relationship between you and the Company.
We are not responsible for delays or failures caused by circumstances beyond our reasonable control, subject to any mandatory obligations imposed by applicable law.
You may not transfer your account or personal course-access licence to another person except where permitted by us or required by law.
We may transfer our rights or obligations in connection with a business restructuring or transfer, provided that doing so complies with applicable law and does not unlawfully prejudice your rights.
